The Law Enforcement Academy held a meeting of the Criminological Forum on the topic “Actual Issues of Enhancing the Protection of the Rights of Entrepreneurs and Their Legal Interests”.
The forum was attended by deputies of the Parliament, representatives of the Presidential Administration, the Security Council of the Republic of Kazakhstan, the Supreme Court, state and law enforcement agencies, the Atameken National Chamber of Entrepreneurs, higher educational institutions, and scientists.
The meeting was devoted to pressing issues of interaction between business and the state, the protection of entrepreneurship in the criminal law sphere, as well as the discussion of the results of the Academy’s research activities in this direction.
As noted by the forum participants, the state should always stand up for the rights of bona fide and law-abiding entrepreneurs. That is why strengthening the legal protection of business entities remains one of the urgent tasks.
The need to toughen criminal liability for illegal interference of officials in entrepreneurial activity was emphasized by the President of the country in his Message to the people of Kazakhstan dated September 2 of this year.
The public danger of criminal encroachment is caused by many negative consequences, and above all, the discrediting and distrust of citizens in government.
In addition, crimes of this category are characterized by high latency and corruption, and therefore require the development of targeted criminal law and other preventive measures.
Following the discussion, a set of recommendations was developed aimed at improving the business climate, ensuring the rule of law in the field of business protection, and creating the right conditions for the development of entrepreneurial initiative.
In particular, it was deemed necessary to give a reliable and objective assessment of the criminal situation on the facts of unlawful interference in the work of bona fide entrepreneurs, the effectiveness of the work of state bodies to support and protect them. The importance of improving criminal policy and crime prevention in this area was also noted.
Proposals will be sent to interested state bodies and scientific and educational institutions.
